Justice Nagesh Bheemapaka Rules Appointment Non-Compliant with Waqf Act

Hyderabad: In a significant ruling, Justice Nagesh Bheemapaka of the Telangana High Court has ordered the removal of Telangana State Waqf Board CEO, Md Asadullah, citing his lack of requisite qualifications for the position. The court found his appointment in violation of Section 23 of the Waqf Act, 1995, which mandates that the CEO must hold a rank not below that of a Deputy Secretary to the State Government.

Contempt Petition Dismissed, But Government Held Accountable

The ruling came while the court was hearing a contempt petition filed by Mohammed Akbar, who alleged that the Telangana government had failed to comply with a previous court order issued on February 28, 2024. The earlier directive had instructed the state to appoint a full-time CEO within four months. However, the court dismissed the contempt plea, stating that contempt proceedings must be initiated by an aggrieved party.

CEO’s Rank Found Below Required Level

The court noted that Asadullah’s position as a Special Grade Deputy Collector did not meet the statutory requirement, leading to his immediate removal. Justice Bheemapaka directed the state government to ensure a legally compliant appointment within the next four months.

Interim CEO to Continue Until New Appointment

Until a qualified candidate is appointed, the court has allowed interim CEO Shaik Liyakat Hussain to continue managing the board’s affairs.

This ruling marks a significant development in the administration of the Telangana Waqf Board, ensuring compliance with legal provisions governing its leadership.
